According to a study conducted by New York University researchers, U.S. Pharmaceutical Companies are spending almost twice as much on advertising as on research and development. This study called The Cost of Pushing Pills: A New Estimate of Pharmaceutical Promotion Expenditures in the United States was published in the January 3, 2008 issue of PLoS Medicine. It analyzed data collected from two sources and concluded that the U.S. pharmaceutical industry spent 24.4 percent of the money earned in sales on promotion and only 13.4 percent for research and development.
This study authored by PhD candidate Marc-Andre Gagnon and Dr. Joel Lexchin, examined data collected from 2004 reports from IMS Health and CAM Group. From these, they were able to get sales and marketing data for the pharmaceutical industry. It was noted by the authors that the numbers from IMS Health and CAM Group did not agree. This was attributed to the different sources of information for both sources as IMS Health gets its information directly from the Pharmaceutical companies while CAM Group gets their information from doctors.
According to CAM Group, $33.5 billion was spent by the pharmaceutical industry for total promotion spending compared to the $27.7 billion reported by IMS Health. The authors combined select information obtained from both sources and deduced that the total promotion spending in 2004 was $57.5 billion.

On March 13, 2008, a new bill was introduced into the House that would create a way for the FDA approval of biogenerics. H.R. 5629 is a bipartisan bill called the Pathways for Biosimilars Act. This bill was introduced by Representatives Anna Eshoo (Democrat, California) and Joe Barton (Republican, Texas).
This bill provides a way for biosimilars to be approved by referencing an approved biological product. As part of the application process, the applicant must submit results from studies that show that their biological product is in fact highly similar to the referenced approved product.
Not only does this bill offer a pathway for the approval of biosimilars, but it also provides for 12 years of exclusivity to the first product licensed (reference product). In addition, this exclusivity can be extended to two years for medically significant new indications and for an additional six months for approvals in the pediatric population.
For conventional medications there are standards in place for the approval of generic compounds, mainly the Hatch-Waxman act. However for biologics there are no set regulatory standards. In addition, biologics are approved following the filing of a Biologics Licensing Application (BLA) as opposed to a New Drugs Application (NDA). This puts monoclonal antibodies under the Public Health Services Act which makes them ineligible for approval under the Hatch-Waxman act.
