This study authored by PhD candidate Marc-Andre Gagnon and Dr. Joel Lexchin, examined data collected from 2004 reports from IMS Health and CAM Group. From these, they were able to get sales and marketing data for the pharmaceutical industry. It was noted by the authors that the numbers from IMS Health and CAM Group did not agree. This was attributed to the different sources of information for both sources as IMS Health gets its information directly from the Pharmaceutical companies while CAM Group gets their information from doctors. H.R. 5629 is a bipartisan bill called the Pathways for Biosimilars Act. This bill was introduced by Representatives Anna Eshoo (Democrat, California) and Joe Barton (Republican, Texas). This bill provides a way for biosimilars to be approved by referencing an approved biological product. As part of the application process, the applicant must submit results from studies that show that their biological product is in fact highly similar to the referenced approved product. Not only does this bill offer a pathway for the approval of biosimilars, but it also provides for 12 years of exclusivity to the first product licensed (reference product). In addition, this exclusivity can be extended to two years for medically significant new indications and for an additional six months for approvals in the pediatric population. For conventional medications there are standards in place for the approval of generic compounds, mainly the Hatch-Waxman act. However for biologics there are no set regulatory standards. In addition, biologics are approved following the filing of a Biologics Licensing Application (BLA) as opposed to a New Drugs Application (NDA).
